Mississippi Attorney General Wants Supreme Court To Overturn Roe v. Wade

On Thursday (July 22), Mississippi’s attorney general launched a legal challenge to the US Supreme Court’s landmark abortion ruling, calling it “egregiously wrong.” 

“The conclusion that abortion is a constitutional right has no basis in text, structure, history, or tradition,” state Attorney General Lynn Fitch wrote in a new legal brief, according to CNN

Fitch added that the case for overturning Roe v. Wade is “overwhelming.” Fitch along with other state attorneys are appealing lower court rulings that blocked the Gestational Age Act, a law banning most abortions after 15 weeks of pregnancy.

Under the Gestational Age Act, later abortions would only be permitted under medical emergencies or several fetal abnormality, NBC News reported.

Mississippi asked the Supreme Court to take up its challenge to the law last year but the Supreme Court said that the state’s arguments “do not require the court to overturn either Roe or Casey,” referring to the two landmark rulings –– Roe v. Wade which legalized abortion prior to viability nationally and Planned Parenthood v. Casey which upheld the court’s initial ruling. 

The justices last year said Mississippi’s attorneys “merely ask the court to reconcile a conflict in its own precedents.” Now, Fitch is taking a more aggressive approach with the state’s latest legal challenge to the court’s landmark decisions.

Oral arguments will most likely begin in late fall or early winter of this year and a decision could be expected next June, according to CNN.

Abortion rights advocates will be watching to see how the conservative majority will decide on this new challenge to legal abortion.
